Shipping Information

1.0 - Interpretation

1.1 - In these terms and conditions:


1.1.1 - ‘Account’ will mean the account opened by the User or Member on the Website which will enable ordering of goods.
1.1.2 - ‘Agreement’ will mean any Terms and Conditions of Use which will include the terms of orders placed by the User or Member through the Website – if this applies.
1.1.3 - ‘Business Days’ will apply to those in Sydney, Australia.
1.1.4 - ‘Customer’ will mean any User or Member who uses, or wants to use, the Website when placing orders.
1.1.5 - ‘Goods’ will mean any kind of product which is described in the order and will include packaging where applicable.
1.1.6 - ‘Intellectual Property’ will mean any rights in the patent, the copyright, trademarks or names, logos or designs, or images which will include photos, multimedia or films, or videos.  This will also include any service marks which may be registered or not registered as applicable.
1.1.7 - ‘Material’ will be and kind of information which will include, but is not limited to any data, source codes and images, including drawings, or images in any format, whether they can be seen or not, stored on the Website or used in conjunction with the Website.
1.1.8 - ‘Order’ will mean any request by the customer to buy goods from Kids Surfwear through the Website.
1.1.9 - ‘Restricted Material’ will mean any kind of product which is displayed for sale which may be for adults over a certain age on the Website.
1.1.10 - ‘Website’ will mean the site on the internet which is located at www.kidssurfwear.com.au that is operated and controlled by Kids Surfwear.



1.2 - Any and all references within this Agreement alluding to the singular will also apply to the plural, and this will apply to any gender, to statutes and acts which will supersede or replace or modify any earlier statute or act; to persons will include any association or body of both corporate or incorporated and vice versa; any headings on paragraphs are only for reference purposes and all these references will apply to this Agreement unless specified as different.  Any references within this Agreement allude to Australian dollars.

2.0 - General Information

2.1 - Any Customer must make sure that they enter the right address for delivery since any parcels or packets which are returned to Kids Surfwear as undelivered will attract another dispatch fee.  Any freight charges made on the first attempt at delivery will not be refunded.


2.2 - All Goods will be sent by Australia Post or any other courier service.  All reasonable attempts will be made to ensure that the Goods reach the delivery address within the specified time as detailed on the Website.  However, if any losses occur because of late delivery, Kids Surfwear will not be liable for those losses.  This applies to the Customer or any other party involved.


2.3 - When any Goods are sent by courier service, the parcel will reach the Customer during the usual business working hours.  When the Goods are delivered, they must be signed for as proof of delivery.  If the Customer is not available when the Goods are delivered, a calling card will be left to inform the Customer on how and where they can receive their Goods.  This will normally be within normal business hours.  The courier service, or postal service, will normally hold the Goods for their maximum holding time.  If the Customer does not respond within that time, the Goods will be returned to Kids Surfwear.  The Goods will be deemed to be unclaimed and further charges will apply for dispatching the Goods again to the Customer.  Earlier dispatch charges are not refundable in any way or form.


2.4 - When the Goods are received back with Kids Surfwear, it will usually take a further three (3) days to process the goods and dispatch again.  When this Order has been sent out, the customer will usually receive an email to confirm this.


2.5 - Deliveries within Australia will take the usual time for standard delivery times.  This will depend purely on where the Goods are being delivered to and will be calculated from the time the Customer receives the ‘Order Dispatched’ email.  Note that this is not from the time of Order. 


Delivery times are as follows – supplied by Australia Post:


Standard delivery 7 – 10 business days
Express post 2 – 4 days


2.6 - If the Customer lives in regional areas, allow for a further three (3) days for delivery.


2.7 - Delivery times mentioned here are for estimated delivery times only.  Kids Surfwear will try to ensure that these days are adhered to.  However, public holidays and peak times for deliveries may interfere with this intention.


2.8 - The Customer will normally be advised in any delay of the seven to ten (7-10) business day delivery time from the Order dispatched email being sent.  The Customer will be offered the right to cancel said order if this is not acceptable.  The customer will also be afforded the opportunity to vary the Order should the Goods be not available.  If the Order is not cancelled, it will be dispatched at the earliest possible opportunity.


2.9 - Kids Surfwear will retain the rights not to accept any Order, or if the Order has already been accepted – to cancel such order if it finds that the Goods are not available.

3.0 - Multiple Item Orders

3.1 - Kids Surfwear will only dispatch the Goods when all items on the Order are available (in stock).  Kids Surfwear, at its discretion, may ask its Customer if they would prefer a part order to be sent out and, if accepted, Kids Surfwear will do so.


3.2 - If a long delay in delivering split orders will be experienced, Kids Surfwear will dispatch any available items as and when they are available at no extra cost to the Customer.

4.0 - Shipping Charges

4.1 - For Customers who have a delivery address within the confines of Australia, a fee of $10 is applicable, for standard postage (7-10 days).  Express shipping will incur a fee of $14 (2-3 days).  Where the weight of said Goods exceeds 20kgs (twenty), an additional charge will be incurred as an excess.


4.2 - The charges will be added at the checkout point and the Customer will be able to see this clearly before payment is made.


4.3 - Kids Surfwear may request that all delivery fees (or any other charges) be paid before dispatch of Goods in respect of each Order.


4.4 - Where the Order includes Restricted Material and this is outlined in law, there must be a person over the age of consent (18) to receive the Goods and sign for them.

5.0 - Damage to Delivered Goods

5.1 - Kids Surfwear will take all reasonable care to ensure that Goods are packed appropriately so that they arrive in good order.  However, Kids Surfwear will not be liable for any damage to Goods or Orders which go missing.

6.0 - Risk and Title in Goods

6.1 - Once Goods have been paid for, title and risk in the Goods passes directly to the Customer when they have been delivered to the noted address.  Anyone who receives such Goods at this address shall be deemed authorized by Kids Surfwear to receive such Goods.

7.0 - Free Standard Shipping

7.1 - Only Orders over $200 will be offered FREE standard shipping and only within the boundaries of Australia.


7.2 - For any kind of delivery within the confines of Australia, Customers should note the standard delivery times by the Australia Post.  Delivery times will depend solely on where the postal address is and is always calculated from the ‘Order Dispatched’ email to the Customer.


7.3 - FREE standard shipping for an Order over $200 can be changed without notice by Kids Surfwear at our own discretion.
